China Digital Economy - Monthly Policy Updates (January 2024)

On December 13, 2023, the Cyberspace Administration of China (CAC) and the Innovation, Technology and Industry Bureau (ITIB) of Hong Kong jointly formulated and released the Implementation Guidelines on the Standard Contract for Cross-boundary Flow of Personal Information Within the Guangdong-Hong Kong-Macao Greater Bay Area (Mainland, Hong Kong), to put in place the facilitation measures on "jointly formulating the standard contract for the cross-boundary flow of personal information within the Guangdong-Hong Kong-Macao Greater Bay Area (GBA), and organizing the implementation, and strengthening the filing management of the standard contract," as specified in Memorandum of Understanding on Facilitating Cross-boundary Data Flow Within the Guangdong-Hong Kong-Macao Greater Bay Area (MoU) signed by the CAC and the ITIB of HKSAR.
On December 5, 2023, the Beijing Municipal Bureau of Economy and Information Technology released the Measures for the Authorized Operation and Management of Public Data Zones of Beijing Municipality (for Trial Implementation) (the "Measures"). These Measures advocate for the establishment of three categories of public data zones, with the aim of advancing the integration, development, and utilization of public data from multiple sources, while unlocking the inherent value of data factors. These zones, broadly categorized as sector-specific, district-specific, and comprehensive foundational zones, are specifically designed to cater to pivotal sectors, key districts, or specific scenarios.
Beijing has rolled out this policy aimed at driving the authorized operation of public data in the city, further harnessing the role of data in economic and social progress. The evolution of public data zones will provide a rich trove of data resources to a wide array of enterprises and institutions, facilitating the application of data across diverse sectors and improving overall data utilization efficiency. Also, this marks a noteworthy initiative in China to promote the market-oriented allocation of data factors, conductive to fostering new economic growth points and propelling the digital economy forward.
The National Data Administration (NDA) and 16 other authorities jointly unveiled the "Data Factor × " Three-Year Action Plan (2024-2026) (the "Action Plan"), aiming to fully leverage the multiplier effect of data factors to empower economic and social development.
The Action Plan emphasizes four fundamental principles: adhering to demand-driven approaches and focusing on practical effectiveness; launching pilot initiatives with a focus on breakthroughs; maintaining an effective market and fostering proactive governance; and promoting openness, integration and ensuring safety and order. It outlines specific work objectives slated for accomplishment by the end of 2026. Within the selected 12 industries and domains, spanning industrial manufacturing, modern agriculture, trade and circulation, transportation, financial services, technological innovation, culture and tourism, healthcare, emergency management, meteorological services, urban governance, and green low carbon, the Action Plan aims to leverage the multiplier effect of data factor and unlock their inherent value.
The Shanghai Municipal Commission of Economy and Informatization has developed and published the List of Artificial Intelligence Demonstration Applications in Shanghai (2023). The List, comprising 21 applications categorized into three major groups, is developed to implement the Regulations on Promoting the Development of the Artificial Intelligence Industry in Shanghai Municipality.
Its objectives include concentrating AI industry resources, establishing a batch of typical and innovative demonstration application scenarios, fostering seamless connection of upstream and downstream of the AI industry chain, driving exploratory leading applications to generate new market opportunities, advancing the widespread deployment of applications to build a critical hub, and propelling the development of large-scale comprehensive application scenarios.
